The house
The seller is Shamir Diamond Group (“Shamir Diamonds,” “we,” “us”), a private jewelry atelier in Leawood, Kansas. The website is shamirdiamondgroup.com. The telephone printed on that website is +1 (704) 737-2752.
You must be 18 or older, and able to make a contract, to buy from us. If you buy for a company, you say you have the authority to bind it.
What the agreement is
A conversation, a photograph, a 360 view, or a number on the website is not a sale. The sale is the written invoice we issue, plus these terms, plus your sending of funds as instructed. If the invoice and these terms differ, the invoice controls for price, metal, carat, shape, and date. These terms control the rest, unless the invoice says otherwise in writing.
By sending funds you accept the invoice and these terms. If you cannot accept them, do not send.
Quotes and prices
Diamond prices move. A number on the site, when we publish one, is an invitation to sit, not a standing offer. A verbal quote is good only for the hour we give it, unless the invoice says a longer hold.
Laboratory-grown inventory is live and can sell while you are reading. Natural stones are pulled for the appointment. We do not promise a stone is still here until it is on the invoice.
Holding a stone
You may hold a diamond, a piece of jewelry, or a setting from this website for an hour and a half. Three pieces at most, at one time. The hold is a courtesy on this browser. It is not a sale, and it is not a promise the piece cannot sell elsewhere. After an hour and a half it leaves the paper.
A verbal quote is good only for the hour we give it, unless the invoice writes a longer hold.
How we settle
We settle in United States dollars by bank wire, ACH, or Zelle. We do not take credit cards, debit cards, PayPal, Venmo, cryptocurrency, or buy-now-pay-later. We do not keep a card number. We do not run a public checkout that pulls from your bank.
- Wire is the ordinary way for a diamond, a custom piece, or any amount larger than your bank will send by Zelle.
- ACH moves on the bank calendar. It can be returned in the first days. We do not treat it as good funds until it is final.
- Zelle is only for amounts your bank allows. The name on the Zelle must match the name on the invoice.
Routing numbers, account numbers, and Zelle addresses are not printed on this website. They appear on the invoice and are confirmed on a call to +1 (704) 737-2752. See How we settle.
Wire fraud
Criminals copy jewelers and title companies. They email a new account and ask you to send now. We will not do that.
- We never change bank instructions by email, text, or WhatsApp.
- If a message says the account has changed, it is not from us. Call +1 (704) 737-2752 using the number on this website, not a number in the message.
- You agree to confirm instructions by telephone before you send. A wire or Zelle that leaves your bank is often impossible to reverse. We are not responsible for funds sent to an account we did not confirm on that call.
Good funds
“Good funds” means collected, cleared money in our name, not subject to ordinary return, reversal, or recall.
- Wire: when the receiving bank posts collected funds.
- ACH: when the payment is final on the clearing calendar. We may wait several business days. If an ACH is returned, the sale is not complete and any piece that left in error must come back at once.
- Zelle: when it posts to the studio account.
We do not start custom work, ship, or hand over a stone on a promise to pay. Split payments are only as written on the invoice.
When it becomes yours
Title to the diamond and the jewelry passes when good funds are in our name and we release the piece to you or to the insured carrier. Until then it is ours. Risk of loss in our studio stays with us. Risk of loss in insured transit follows the carrier’s cover, which we place as a matter of course.
The GIA or IGI report travels with the center stone. A photograph or a 360 view is a likeness. The stone in the hand is the stone.
Custom work
A custom ring is made for one hand. Once bench work, a special order, or a CAD you have approved has begun, the deposit named on the invoice is earned. The invoice says whether that deposit is refundable.
Size, metal, and design changes after approval can change the price and the date. We will write that before we go further.
Diamonds and reports
Every center stone we sell leaves with its GIA or IGI report unless the invoice says the stone is not yet papered. We verify the report number on the laboratory’s own site. Grading is the laboratory’s opinion. Color, fluorescence, and cut are also judged in the room.
Natural and laboratory-grown are different goods. The invoice will say which one you are buying. We do not sell a lab-grown diamond as a natural diamond.
Tax, shipping, and the world
Kansas sales tax is collected where the law requires it. The rate is the rate then in force, not a number invented here. If you take the piece in another state, tell us before the invoice so we can treat the tax correctly.
Finished work leaves fully insured. The invoice names who pays the freight. International clients settle by wire in US dollars. Duties, VAT, and the foreign bank’s fees are yours. We do not mark a package below its value.
Returns
Custom work, engraved work, and stones ordered to a specification are not returnable once made, unless the invoice says so or the goods are not as invoiced.
Stock goods, if we later offer them with a return window, will say so on the invoice. Any return must be unused, in its papers, and sent insured as we direct. There is no default thirty-day right unless the invoice writes one.
Because we do not take cards, there is no chargeback. A dispute is a conversation, then Kansas law, not a card network.
Who is sending
The name on the sending account should match the name on the invoice. If it does not, tell us before you send. We may ask for a government identification, a selfie with the invoice, or a bank letter on larger invoices. That is how we know the person in front of the stone is the person who paid.
Federal law can require a report of large cash. We do not take cash through this website. If we ever take cash in the room above the federal threshold, we will file what the law requires.
What we can and cannot promise
We will make the piece as invoiced, with the report named, in the metal named. We do not promise a future appraisal value, a resale price, or that a laboratory-grown diamond will hold a market. Photographs, renderings, and 360 views are as close as the camera allows. The stone in the hand governs.
If the goods are not as invoiced, our duty is to replace them or refund the invoiced amount. We are not liable for lost profit, a delayed wedding date, or a feeling about a stone after you have sat with it and sent funds.
Kansas law
These terms are governed by the laws of the State of Kansas, without a conflict-of-law rule that would send the dispute elsewhere. Venue is in the state courts of Johnson County, Kansas. If a line here cannot be enforced, the rest still stands.
We may update this page. The date at the top is the version that applies to invoices issued after that date. An invoice already issued keeps the version named on it.
